Canadian Visitor Visa (TRV) Application Refusals

Failure to meet Section 179(b) of the Immigration and Refugee Protection Regulations (IRPR) is the most frequently cited reason for refusal of a visitor visa application to Canada. Most visitor visa refusals stem from failure to meet this requirement in different ways.

Section 179(b) of IRPR states,

  1. Issuance – An officer shall issue a temporary resident visa to a foreign national if, following an examination, it is established that the foreign national

(b) will leave Canada by the end of the period authorized for their stay under Division 2 [Conditions on Temporary Residents]

Visa Refusal Based on Travel History

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR based on your Travel History

Refusals based on travel history are difficult, but can be overcome with a new application. IRCC refuses applications based on travel history when an applicant has not been outside their home country previously, or has traveled outside their home country but not very often. Sometimes this is even grounds for refusal when an applicant has extensive travel history. “Lack of travel history” can be overcome in a new application with travel to other countries or other means.

Visa Refusal Based on Purpose of Visit

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR based on the purpose of your visit

A visitor visa refusal based on the purpose of the visit is tricky, because it is such a highly discretionary reason for refusal. Sometimes this reason for refusal is given because not enough detail was provided on the application regarding why specifically the applicant was coming to Canada. For example, if the applicant said they were coming to visit their friend, this is vague and the officer could have doubts about the reason. Whereas, if the applicant said that they were coming to visit their friend because the friend was getting married in Niagara Falls and included a copy of the wedding invitation, this would be a much better way to explain why the visa is needed.

Visa Refusal Based on Family Ties

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your family ties in Canada and country of residence

A refusal based on family ties of the applicant, whether in Canada or in the country of residence or both, are extremely common grounds for refusal of a visitor visa. If the applicant has family in Canada, then this can work against the applicant as it is one reason that they may not wish to return home at the end of their stay in Canada. For example, if the applicant is applying to visit his wife in Canada and all of his family resides in his home country, then this requires detailed explanation regarding the nature of the applicant’s ties both in Canada and at home.

Visa Refusal Based on Immigration Status

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your immigration status in your country of residence

In order to submit an application for a visa to come to Canada, the applicant is required by law to have legal status in the country where they are located when they submit the application. Besides having legal status there, the applicant also must have been admitted to that country for a minimum amount of time or their visa application will be refused. Sufficient proof of the applicant’s legal status in their country of residence at the time they make the application has to be included when they apply for a visa to Canada, otherwise the application will be refused.

Visa Refusal Based on Personal Assets and Financial Status

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your personal assets and financial status

As an applicant for a visitor visa to Canada, it is extremely important to prove to the immigration officer that you have the money to finance your trip to Canada. In a visa application, you have to prove that you:

  1. Have sufficient funds to pay for your ticket and travel to Canada
  2. Have sufficient funds to pay for the costs during your visit such as tourism, meals, lodging, gifts, etc.
  3. Have sufficient funds to pay for your ticket and travel back to your country of residence

If IRCC does not believe that you have sufficient money to pay for your trip and then some, they will refuse your application based on personal assets and financial status. Also, be aware that “personal assets and financial status” refers to the funds held by and accessible to the applicant for the visa, not the Canadian inviter. An application for a Canadian visa should include financial information and documents belonging to the Canadian citizen or permanent resident who has invited the foreign national for a visit, however the applicant for the visa must also show funds of their own.

Visa Refusal Based on Current Employment Situation

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your current employment situation

Because it is so important for applicants for a Canadian visa to show that they have enough money to finance their trip to Canada, it is also important that they show where this money has come from. The absolute best way to show the source of their funds is to prove that they are employed. Applicants for a Canadian visa are considered at higher risk to break the conditions of their entry and overstay in Canada if they are unemployed at the time of their application. A job in the visa applicant’s home country is one of the strongest ties that they can show to their country of residence as proof that they will return when their trip to Canada is over.

Being self-employed or enrolled full-time in school is also a strong tie to the visa applicant’s home country. However, if the applicant is out of school and is not working in any way, this is a significant challenge to overcome on a Canadian visa application.

Visa Refusal Based on Length of Proposed Stay

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your length of proposed stay in Canada

Because visitors who enter Canada can stay up to a maximum of 6 months, unless they are advised otherwise by Canada Border Services Agency when they arrive, many people believe that they should state “6 months” as their proposed length of stay on the visitor visa application. However, “length of proposed stay” is a very common ground for refusal. Asking for the maximum amount of time allowable to visitors in Canada is not usually viewed as reasonable by officers, and makes it look more likely that the applicant will not leave on time.

Visa Refusal Based on Employment Prospects in Country of Residence

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident as stipulated in paragraph 179(b) of the IRPR because of your employment prospects in country of residence

As described above, the financial documentation of the applicant is the most important part of a Canadian visa application. Applicants for a visa need to show not only that they have the money to pay for their trip to Canada, but also that they are employed as proof of where their funds come from. If the unemployment rate is high in the country of residence of the visa applicant, then this can negatively impact the Canadian visa application. If an immigration officer believes that an applicant is likely to lose their job as a result of traveling to Canada, or that they are unlikely to be able to get a job if they are not currently working, “employment prospects in country of residence” can be used as grounds for refusal of the visa application.

Visa Refusal Based on Insufficient Funds, Income, or Assets

  • I am not satisfied that you have sufficient funds, including income or assets, to carry out your stated purpose in going to Canada or to maintain yourself while in Canada and to effect your departure. 

An immigration officer cannot issue a visa to Canada if they believe that the applicant does not have enough money to pay for their trip to Canada for the purpose that they have stated on the application. They also cannot issue a visa if they do not believe the applicant has enough  money to pay for their trip back to their home country. If the purpose for their visit would reasonably cost more money than the applicant has demonstrated that they have, then this is a likely reason for refusal of the visa application.

Visa Refusal Based on Insufficient Documentation of Income and Assets

  • You have not provided sufficient documentation to support your / your host’s income and assets. 

If it is not already clear, an applicant for a visa to Canada is required to prove that they meet all the requirements for issuance of the visa – the burden of proof is on the visa applicant, not on Canadian immigration. If the applicant has stated that they have access to a certain amount of money, or that their Canadian host has access to a certain amount of money to support the visa application, then they must demonstrate this with documentation. If the applicant does not provide documentation to show what they are saying is true, then this can be grounds for refusal of the visa.

Visa Refusal Based on Misrepresentation

  • You have submitted documentation which lacks authenticity as part of your application. This has diminished the overall credibility of your submission

In the event that IRCC does not believe that the documents or information you have submitted are genuine, this alone is grounds for refusal of the application under section 40 of the Immigration and Refugee Protection Act for Misrepresentation. If an applicant for any visa or type of immigration to Canada has been determined by IRCC to have misrepresented, then they will be the subject of a bar from entering Canada for a certain period of time and any future immigration applications will be viewed with skepticism.

Studying in Canada is a dream come true for many African students. When you receive a letter of acceptance from a Canadian school, it might seem like the hard part is over. However, the truth is that it can be a lot harder to get a Canadian study permit than you think.

 

OVERCOME YOUR STUDY PERMIT REFUSAL

 

According to information from IRCC, about 30 percent of all study permit applications are refused. Since studying in Canada is so popular, that’s tens of thousands of prospective students who have been accepted to a Canadian school, but whose study permit applications are refused.

What Can I Do If My Study Permit Application Is Refused?

If your study permit application is refused by IRCC, there are two courses of action you can take:

  1. Appeal the refusal, or;
  2. Address the reason(s) it was refused in a new application.

To be successful either way, you first need to understand why your application was refused. Usually, the main reason for refusal will be listed in the refusal letter you receive. You can also request access to the notes the visa officer reviewing your file made, to get a better idea of how to address the concerns brought up.

1. IRCC questions your ability to financially support yourself

When you submit a study permit application, you need to demonstrate that you have enough money to pay for the trip to Canada, pay your tuition fees, and support yourself and any accompanying family members while you’re studying.

This is called “show money”. Usually, the government asks for six months of bank statements that show that you have enough show money. If the government doesn’t believe that you have enough money to support yourself and your family in Canada, they could refuse your application.

How to address a problem with show money:

If your application is refused because IRCC questions your ability to financially support yourself, you should carefully review the financial documents you submitted with your application. Make sure that you address the concerns raised by the visa officer and submit additional documents to prove that you meet the show money requirement.

The amount of show money required is sometimes intimidating to clients who don’t want to spend such a large amount. Don’t worry! You do not need to spend the show money. You only need to show the Canadian government that the funds are available to you, if you need them.

 

2. IRCC questions whether you will leave the country after your studies

A study permit is a temporary visa, which means that it has a validity period and an expiration date. In your study permit application, you need to convince the visa officer that you will leave the country when your study permit expires.

That does not mean that you cannot apply to extend your study permit, or stay permanently. In fact, there are many programs designed by the government to help students stay and work in Canada following their studies, or transition to permanent residence.

What it means is that the visa officer has to trust that you will not stay in the country illegally when you are out of status. Usually, this is a problem if you don’t demonstrate that you have good reasons to want to return home.

How to address a problem of intent:

Usually, the only way to address this concern is in your personal statement. If the visa officer isn’t convinced with the narrative you’ve provided them, you need to rework your statement to try to address their concerns directly. Keep in mind the concept of dual intent. Applicants with dual intent can have the intention to come to Canada temporarily as a student or worker, while also intending to stay permanently.

Providing the visa officer with a convincing narrative for why you want to come study in Canada, and why you will return home after you graduate, is one of the trickiest parts of your application. In-depth knowledge of the kinds of things that can concern visa officers, and how to address them, can go a long way here.

3. IRCC questions your choice of program

Study permit applications are sometimes refused if the visa officer doesn’t understand the logic of your choice of program. Someone with a bachelor’s in nursing from the Philippines and four years of experience working as a nurse who wants to study hotel management, for example, could be questioned. The chosen program in Canada doesn’t seem to align very well with the applicant’s educational background or employment.

How to address a problem with program choice:

If the program you have chosen seems odd, given your past education or work experience, you need to clearly explain why you want to study it in your personal statement. This is another case where seeing the visa officer’s notes can really help.

Even if it doesn’t seem obvious, applicants usually have good reasons for choosing the programs they apply to. In the example above, maybe the nurse’s uncle recently purchased a hotel, and he or she wants to change career paths to help him manage his business. However, you have to clearly communicate your motive to the visa officer so they can understand your choice.

4. IRCC questions your letter of acceptance

Before you can apply for a study permit, you have to receive a letter of acceptance from a Canadian educational institution. The school that issues your letter of acceptance has to be a registered Canadian educational institution. You also have to meet all program requirements. If the visa officer doubts that your letter of acceptance is genuine, or that you have actually met the program requirements, he or she might refuse your letter of acceptance.

How to address a problem with your letter of acceptance:

Review the school documents that you submitted. Make sure that all of the documents are clear and easy to read, and provide any additional supporting documents that you can.

Unfortunately, there are some fake institutions designed to cheat people out of their money by issuing fake acceptance letters and charging application and tuition fees. Check to make sure that the school you were accepted to is on this list of designated learning institutions.

5. IRCC questions your travel or identity documents

If you don’t have a complete record of your travel history, or if your identity documents are unclear, IRCC may refuse your study permit application. IRCC must be able to identify if you are medically or criminally inadmissible to Canada.

How to address a problem with travel or identity documents:

If the visa officer thinks there are blank spaces in your travel history, review the documents you submitted and the visa officer’s notes to find what time periods are problematic. When you re-apply, be sure to include additional supporting evidence to cover these periods.

If the problem is with your identity documents, review your application to make sure that they were clear and easy to read.

Can I apply for an open work permit if my spouse or partner has applied to sponsor me?

In order to be eligible to apply for a spousal sponsorship open work permit, a foreign national must have applied for permanent residency sponsorship from within Canada through the in Canada stream of the spousal sponsorship program.

  • If you have not submitted your sponsorship application: The sponsorship, permanent residence, and open work permit applications may all be submitted together in a single envelope in hard copy. Ensure that all supporting documentation and required proof of payments for all applications are included. The applications should be submitted to the Case Processing Centre in Mississauga (CPC-M), Ontario.
  • If your permanent residence application is submitted but has not yet received approval in principle: The open work permit application may be submitted in hard copy to the Case Processing Centre in Vegreville (CPC-V), Alberta.
  • If your permanent residence application has been approved in principle: The open work permit application may be submitted online or in hard copy to the Case Processing Centre in Vegreville (CPC-V), Alberta.

Approval in principle (AIP) means that a person’s permanent residence application has been cleared by IRCC as meeting the eligibility requirements, but the application has not yet passed through processing for medical exams and security/background checks. While this means the application has successfully passed through several stages of processing, permanent residency may still be denied after receipt of the AIP.

A foreign national must have valid status in Canada (visitor, student, worker, etc.) in order to submit a work permit application at the same time as their permanent residence application. If an applicant is out of status in Canada, they must wait until their permanent residence application has received approval in principle to submit their work permit application.

Eligibility requirements for a spousal work permit and visa

In order to qualify for a spousal open work permit, you must meet certain minimum requirements, including:

  • Must be in a genuine relationship with a qualifying foreign national principal applicant, permanent resident, or citizen;

Reasons spouse open work permit are rejected

There are many reasons a spousal open work permit may be rejected. Here are six of the most common reasons:

  1. Principal applicant is living outside Canada – Your spouse must be living inside Canada on eligible, legal status in order for you to apply for a spousal open work permit. If your spouse lives outside Canada, this may be a reason your application is refused.
  2. No evidence that your spouse is attending a DLI – If you are applying for a SOWP as the spouse of a student, your spouse will need to provide sufficient evidence that they are studying at a Canadian Designated Learning Institute (DLI) and are actively enrolled in class. Excluding this documentation could result in a refusal.
  3. Lacking proof of funds – If the officer reviewing your case is not convinced that you and your spouse will have sufficient funds to support your stay in Canada, your application may be refused. For this reason, it is important to include financial documents with your application that will satisfy the officer of your financial stability.
  4. Missing proof of employment – If you are applying for a SOWP based on your spouse’s employment, it is important to provide documents that support their employment in Canada.
  5. Insufficient ties to home country– When applying for temporary status in Canada, the officer must be satisfied that you will leave by the end of your authorized stay. For this reason, it is important to include proof of any ties you may have to your home country. If the officer is not convinced that you will leave Canada by the end of your authorized stay, your application may be refused.
  6. Absence of proof of a genuine relationship– Since the spousal open work permit is based on your relationship to your spouse or common-law partner, it is important to provide sufficient proof of your genuine relationship. If the visa officer is not satisfied that your relationship is genuine, this could be a reason for refusal.

What happens to my spouse’s open work permit application if my spouse and I separate or divorce?

If you and your spouse divorce or your common-law relationship ends after you’ve received your spousal open work permit, your permit will not be revoked. However, if your relationship ends while your application is still processing, you must inform IRCC of your updated relationship status, and will no longer be eligible for a SOWP.

What is the start-up visa program?

Canada’s start-up visa program offers African entrepreneurs, spanning from Nigeria to Ghana, Kenya to South Africa, the chance to immigrate and establish new businesses in Canada. African entrepreneurs must demonstrate that their business is innovative, will create new jobs for Canadians, and can compete on a global scale.

What are the requirements for Canada’s start-up visa?

There are four requirements you need to meet in order to be eligible for a Canadian start-up visa:

  1. Have a qualifying business:
    • You must hold at least 10% of the voting rights attached to all shares of the company
    • Together with the designated organization, you must hold at least 50% of the voting rights attached to all shares of the company
  2. Have a letter of support from a designated organization:
    • You need to demonstrate that you have the support of a venture capital fund, angel investor group, or business incubator
    • In order to do this, you must pitch your business idea and convince the organization that it is worth supporting
    • The process of pitching your business idea will be different for each organization
    • If your pitch is successful, you will receive a letter of support from the organization which must be included in your start-up visa application
  3. Meet the language requirements:
    • You must take a language test from an approved agency and show that you meet the minimum level of the Canadian Language Benchmark (CLB) 5 in either English or French in speaking, reading, listening, and writing.
  4. Proof of funds:
    • You need to show that you have enough money to support yourself and any dependents once you arrive in Canada. The amount you need depends on the size of your family.

Designated organizations for start-up visa

As part of the eligibility requirements, you will need to provide proof (Commitment Certificate and Letter of Support) that your business is in fact supported by a designated organization. These documents will cover the relevant details of your arrangement with one or multiple designated organizations, and are paramount to your startup visa application. Unlike federal and provincial investor programs, where applicants must invest their own capital, no investment of their own funds will be required.

Instead, those who meet the eligibility requirements must secure a minimum of $75,000 from a Canadian angel investor, or a minimum of $200,000 from a Canadian venture capital fund recognized by the government of Canada. If the applicant is accepted into a recognized Canadian business incubator, no investment capital is required.

How to apply for a start-up visa

  1. Fill out the application form:
    • Fill out the Generic Application Form for Canada
    • Click the “Validate” button on the form, and make sure that you have completed all required fields
    • Print the validated application form, making sure to include the barcode page
    • Sign and date the form
